Description of the procedure
The information application about a tobacco products
With the law applied on 30 October 2003 named changes in the law “On Restrictions regarding Sale, Advertising and Use of Tobacco Products” (further in the document – law) which include right norms extending from the directive 2001/37/EC, item 7.1 says:
The manufacturers and importers of tobacco products present the ingredient list and the amount of them used in their products according to the brand name and the type of it each year until 31 December (for the first time until the 31 December 2004) to the Health Inspectorate (HI).
Thing shown in the list: the functions and category of the ingredients, the data about the available toxicology tests about the ingredients (which may be in burnt or not burnt kind) available to the manufacturer or the first importer, if necessary to point their influence to health and the ability to cause addiction. The list must be designed after each included component in deceasing order according to their weight in the product. A declaration must be added to the list, which accounts the reasons why this ingredient is included in the tobacco product.
Health Inspectorate ensures the access for the consumer to the data supplied by the manufacturers and first importers about each tobacco product including the list of the ingredients, which specifies the amount of nicotine, tar and the carbon monoxide in each piece of the product.
The Health Inspectorate also ensures the confidentiality of information supplied by the manufacturers and first importers about the specific formula and is a secret of the entrepreneur.
Health Inspectorate has developed a procedure for information application about tobacco products to the HI:
1. Enterprise activities
The manufacturers or importers of the tobacco products get the information about the declaration of the products and the declaration form in the HI homepage www.vi.gov.lv in the section Procedures.
1.2. Manufacturers or importers fill in the form about the declaration of a tobacco product in the Internet and save the filename after the scheme given: “TIP_name_of_enterprise_year”
1.3. Filling out the form, you must take in account the restrictions and instructions added in the electronic format. Filling out this form in the next years repeatedly, you must fill in the registration number given to you by the HI in the first visit.
1.4. The filed in form has to be sent to the e-mail address dati@vi.gov.lv and printed out in two exemplars.
1.5. The printed out documents are marked with the mark of the enterprise seal and the sign of the person who is going to hand in the documents to the HI.
1.6. Prepares a package of documents for adding it to the declaration form according to the demands described in the law item No. 7.1 part 1, int. al.:
1.6.1. The qualitative and quantitative structures of the tobacco product in a deceasing order;
1.6.2. The functions and category of the ingredients;
1.6.3. The data about the available toxicology tests about the ingredients;
1.6.4. Ingredients influence to health and the ability to cause addiction;
1.6.5. A declaration about the reasons why this ingredient is included in the tobacco product.
1.7. Handing over documents about tobacco products repeatedly (next year) is necessary only if the structure of the tobacco product has changed.
The documents which are accounted in the point 1.6 have to have a juridical force – it must apply to the demands set in the rule No.154 “The development and design of documents” point 18 and 19 of Cabinet of Ministers of 23 April, 1996. They must have:
- The author of the document (name of the enterprise).
- Date,
- The name of the document development or signing place,
- Sign,
- The name of the document type,
- Number of the document.
- The documents can be sent in a registered letter via mail or to visit us personally in the HI in working days until the each year’s 31 of December.
- The declaration form is an attestation for the tobacco product manufacturer or importer that the handing in of the information about tobacco products as said in the law has been done.
- HI actions
- HI ensures a possibility for the consumer to get acquainted with nicotine, tar and carbon monoxide content (mg) in specific tobacco products.
The form must always be filled in the Internet to get the latest version of the form. The form is protected against unauthorized changing.
The HI sorts out incomplete or incorrectly filled in forms and sends them back to their submitters, explaining the mistakes orally or in written form.
